“..Unfortunately, the PSU Lender took the physical possession of the ‘secured assets’, under the SARFAESI Act and announced their public auction. As their distress value exceeded the ledger dues recoverable, any ‘One Time Settlement’ of the dues was ruled out. Yet, to our surprise, Deshpande Sir successfully negotiated the OTS of dues as also got us an extension of time to honour it. Not only it saved us from great embarrassment, negative press publicity but actually saved substantial sum of money! We appreciate the expertise of Deshpande Sir in credit as also in Legal matters.

Fortunately, it was successful and we could recover, substantial dues. As a pleasant surprise, Deshpande Sir also convinced the top brass of the MNC to successfully trade off our inadvertent successive violations of FEMA Rules, which attracted jail term for the Directors (Husband & Wife).

We operated 2 factories in the same premises at MIDC, Bhosari, Pune. By end of CY 2008, a devastating fire in one factory ruined both the flourishing businesses. A major export consignment, ready for loading was burnt to ashes, causing extensive damages to the premises & machinery. Insurance claims were rejected; appeals were dismissed. The PSU Banker failed to admit their faults in not renewing the insurance policy sold by themselves. The Insurance Consultant appointed later was of no help. None of our personal/political contacts helped us. Production had hampered; losses were mounting. ...

To be frank, I had no hopes from BS, a newly established Consultancy Firm. Deshpande Sir burnt midnight oil, invoked the Arbitration clause in the Insurance Policy overlooked by all others. He followed up on war footing and got a Sole Arbitrator appointed in 15 days; accompanied me thrice to brief the Advocate. He also helped the Advocate in the preparation of the voluminous ‘Statement of Claim’. Unfortunately, just 36 hours prior to the 1st Arbitration Hearing, the advocate met with a major car accident. Due to the exigency, the Arbitrator postponed the hearing only by 2 days.

Deshpande Sir [who had no previous experience of arbitration] had to fight my claim, cross examine the Insurance Surveyor, etc. In his maiden ADR Consultancy; Deshpande Sir not only got us a favourable Adhoc Arbitration Award in 10 weeks but secured an Interim favourable award in the 1st Hearing.

Later, Deshpande Sir successfully mediated [again maiden attempt] in our major commercial dispute with the Gulf based MNC. We travelled together to Libya; FTZ, UAE & the RAK. The ease with which Deshpande Sir handles Financial and legal matters together is just amazing.”

We are quite grateful to him for such proactive guidance. Without any litigation, avoiding strenuous DRT procedures; we got the justice and physical possession, just in time.
